On March 6, 2017, Pablo Rubio Ortiz suffered a grievous traumatic brain injury while working as a carpenter’s assistant at a new home development construction site.
Strong winds caused a partially constructed concrete block wall to collapse onto Mr. Rubio Ortiz’s head.
According to the case, the wall should have been braced, but was not. A designated safe area around the wall should have been clearly marked, but was not. Workers also should have been warned about the danger posed by the strong winds, but no such warning was provided.
The collapse left Mr. Rubio Ortiz with a traumatic brain injury that resulted in significant pain and suffering and economic losses. His injuries also affected his ability to provide support and services to his wife and son.
Pursuing the Parties Responsible for the Safety Failures
BRILL & RINALDI, The Law Firm prosecuted the case in Miami-Dade County Circuit Court against the parties responsible for the alleged safety failures that led to the wall’s collapse and Mr. Rubio Ortiz’s injuries.
Construction accident litigation can present particularly difficult legal issues because numerous contractors and other entities may be involved at a single jobsite. These cases may also require overcoming legal barriers such as workers’ compensation immunity.
Those challenges did not deter the firm.
The litigation continued for more than seven years as BRILL & RINALDI, The Law Firm pursued accountability and compensation for Mr. Rubio Ortiz and his family.
Confidential Settlement Reached After More Than Seven Years
After more than seven years of litigation, BRILL & RINALDI, The Law Firm reached a confidential settlement with the last remaining defendant.
Reflecting on the case, David Brill, managing partner of BRILL & RINALDI, The Law Firm, said:
“I am immensely proud to say that we were tireless and imaginative in our pursuit of justice and accountability for Mr. Rubio Ortiz and his wife and son.”
The case demonstrates the persistence that complex construction injury litigation can require, particularly when catastrophic injuries, multiple responsible parties, and workers’ compensation immunity issues are involved.
